1. Parties and Acceptance
These Terms of Service ("Terms") are entered into between Dbgaze Bilgi Teknolojileri, which provides the dbgaze service ("Service", "we"), and the individual or entity that registers for or uses the Service ("Customer", "you"). Accepting these Terms at sign-up forms a binding agreement. If you do not accept them, you may not use the Service.
2. The Service
dbgaze is a database monitoring service that collects performance metrics via a read-only agent installed on your database server, displays them in a cloud dashboard, and provides alert rules and reporting. The agent collects only numeric metrics and counters; it does not collect database query text (SQL content).
3. Account, Authorization and Responsibilities
You are responsible for the security of your account and credentials. You undertake to install the agent only on servers you are authorized to monitor, to grant the agent only a read-only database user, and to provide accurate connection details. You are responsible for all activity under your account.
4. Acceptable Use
You may not use the Service for unlawful purposes, to gain unauthorized access to third-party systems, in a way that overloads the infrastructure or endangers the Service's security or integrity, or for reverse engineering.
5. Subscription, Fees and Billing
The Service offers a free plan and paid plans. Paid plan prices, scope and billing period are shown in the dashboard and on the pricing page. Fees are charged at the start of each period; upgrades/downgrades take effect in the next period. Unless stated otherwise, paid fees are non-refundable.
6. Customer Data and Privacy
How we process your personal data is set out in the Privacy Policy and the KVKK Notice, which form an integral part of these Terms. The metrics we collect are used solely to provide the Service to you.
7. Intellectual Property
All intellectual property rights in the Service, software, interfaces and brand belong to dbgaze. These Terms grant you only a limited, non-transferable, non-exclusive right to use the Service for the term of use; no ownership is transferred.
8. Service Level and Interruptions
The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free; temporary interruptions may occur due to maintenance, updates or unforeseen causes. We use reasonable efforts to keep the Service available.
9. Limitation of Liability
To the maximum extent permitted by law, dbgaze is not liable for indirect, incidental, special or consequential damages, loss of data or loss of profit. dbgaze's total liability is limited to the fees paid by you in the twelve months preceding the event giving rise to the claim.
10. Suspension and Termination
You may close your account at any time. We may suspend your access or terminate your account on breach of these Terms, payment default, or use that threatens the Service's security. On termination, your data is deleted or anonymized in line with the Privacy Policy and applicable law.
11. Changes
We may update these Terms from time to time. For material changes we will notify you and, where needed, request your renewed consent. Continuing to use the Service after a change means you accept the updated Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the jurisdiction of the Istanbul Courts and Enforcement Offices.
